As defined by Florida law; a person commits the crime of “Conspiracy” when he
or she “agrees, conspires, combines, or confederates with another person or persons to commit any offense.”

Suppose the State is prosecuting you for such an offense, and your attorney can show that, effectively renouncing your intention, you persuaded those with whom you conspired not to go through with the crime or that you prevented the commission of the crime.
In that case, the State cannot win its case against you.
Remember: the law requires the State to prove its case against you beyond all reasonable doubt. Thus, to win your case, it is not your attorney’s job to show you are innocent. Instead, by carefully studying the facts and the law, it is your attorney’s job to show that reasonable doubt, or better yet, several reasonable doubts exist in the State’s prosecution.
What are the penalties for Conspiracy?
If the defendant conspired to commit a capital felony, Conspiracy is a first-degree felony punishable by up to thirty years in prison on probation.
If the defendant conspired to commit a life felony or a first-degree felony, Conspiracy is a second-degree felony punishable by probation for up to fifteen years.
Suppose the crime to which the defendant conspired is a felony of the 2nd degree or certain other 3rd-degree felonies. In that case, Conspiracy is a 3rd-degree felony punishable by a term of probation of up to five years in prison.
Suppose the crime for which the defendant conspired is any other 3rd-degree felony. In that case, Conspiracy is a first-degree misdemeanor, punishable by a term of probation of up to one year in the county jail.
If the defendant conspired to commit a 1st or 2nd-degree misdemeanor, a conviction for Conspiracy is a 2nd-degree misdemeanor punishable by up to sixty days in county jail on probation.
