Defending Misdemeanor Charges in Palm Beach County

A misdemeanor is defined by Section 775.08(2), Florida Statutes, as “any criminal offense that is punishable under the laws of this state, or that would be punishable if committed in this state, by a term of imprisonment in a county correctional facility, exce

pt an extended term, not in excess of 1 year. The term “misdemeanor” shall not mean a conviction for any noncriminal traffic violation of any provision of chapter 316 or any municipal or county ordinance.”

In Florida Misdemeanors are primarily divided into two categories, First Degree and Second Degree. A first degree misdemeanor, like battery, is punishable by up to one (1) year in the county jail and a fine of up to $1,000.00. A second degree misdemeanor, like assault, is punishable by up to sixty (60) days in the county jail and a fine of up to $500.00. Florida also has hybrid misdemeanors, like DUI and Reckless Driving, where the maximum possible punishments vary depending on the facts of the case.
